General Contracts are made and accepted subject to these Conditions of Sale. Contracts that are made in Scotland shall be governed by Scottish Law otherwise this contract shall be governed by English Law and no other.
Quotations
All prices include VAT, unless expressly stated otherwise Firm price quotations are valid for a period of 28 calendar days after which time they may be subject to alteration. Where quotations are based on details provided by the customer, such quotations are subject to the accuracy of those measurements and/or information.
Conditions and Warranties
Natural products may show some colour variations. Where the Garden Landscape Company agrees to provide a specifically designed plan, the customer agrees to check the accuracy and suitability of the plan.
Delivery
The Garden Landscape Company will do all that it reasonably can to meet the date given for delivery. In the case of unforeseen circumstances, beyond the reasonable control of The Garden Landscape Company, The Garden Landscape Company may not be able to do so. In such circumstances The Garden Landscape Company will contact the customer and agree an alternative date. The customer will also do all that he/she reasonably can to enable the delivery to take place on the given date. In the unforeseen circumstances beyond the reasonable control of the customer ,the customer may not be able to do so. In such circumstances the customer will contact The Garden Landscape Company and agree an alternative date.
Risk and Liability
As soon as The Garden Landscape Company has delivered the goods, the customer will be responsible for them. You are responsible for checking the quantity and informing us of any breakages and/or shortfall in the delivered order. You must advise us by telephone immediately and give us written notice within three working days of unloading of any claim for shortage or damage.
Ownership of the Goods
Ownership of the goods shall remain with The Garden Landscape Company and shall not pass to the customer until the agreed price for them, together with all other sums due from the customer to The Garden Landscape Company, have been paid in full. Consents The customer is responsible for obtaining all necessary planning permission and local authority consents and permissions for any work carried out. In carrying out any work The Garden Landscape Company will assume that the necessary consents and permissions have been obtained and accepts no responsibility whatsoever in the event that they have not.
